Thanks for the analysis. But I don't quite understand how having the decision bottled up for years in the Ninth Circuit is a good thing. When you are my age, time is not on our side.

You mentioned previously that an en banc review would wipe the slate clean.

Wouldn't that effectively erase this decision?

Yes, if the Circuit accepts the case en banc, the panel decision is instantly vacated.

I wasn't being altogether facetious about my age. My fear is that Justices Ginsburg and Kennedy will retire soon. They have been the biggest supporters of gay rights in the history of the Supreme Court. If they retire and are replaced by justices who are less supportive, it will be a generation before we have equal rights in this country. I think we should be hoping that the Court hears a DOMA and other marriage case sooner rather than later.
